Compliance requirements

The bidder must confirm the standard exclusion grounds: participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. If any ground applies, the bidder may submit evidence of self-cleaning, where permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have, within the last 36 months, properly performed as the main contractor at least one design assignment for a publicly used road at the preliminary design and detailed design stages, for which a building permit was issued. The value of that reference work must have been at least EUR 30,000 excluding VAT. In the ESPD, the bidder must provide the reference description, value, time period, client details and, where applicable, the public procurement reference number, and must show that it acted as the main contractor. The service must involve a design project manager responsible for managing the design work and performing the contract, who must hold at least the qualification of Chartered Road Engineer, level 7, or an equivalent qualification. The contracting authority also accepts as equivalent, for qualifications issued before 01/07/2025, a qualification with specialisation in road construction and maintenance and competence in design management. Proof of the required qualification must be submitted on request. The tender must be submitted in the required structure, the bill of quantities must be completed, and the bidder must confirm that the tender complies with the procurement documents and, where necessary, that equivalence has been demonstrated. The bidder’s right of representation must be evidenced; in a joint tender, a power of attorney for the joint bidders must be submitted. If the bidder is not visible in the Estonian register or is represented by an authorised person, the relevant power of attorney or a document from the country of establishment must be provided. The bidder must also confirm that its place of residence or establishment is in an allowed country and not in the Russian Federation or the Republic of Belarus.
