Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, or offences related to the commission of a terrorist act or terrorist activities, where this gives rise to an exclusion ground. If any such ground applies, information on self-cleaning or restoration of reliability must also be provided, where permitted. For subcontractors, the bidder must confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must show annual net turnover in road construction of at least EUR 520,000 in each of the last three financial years (2023–2025). As regards construction experience, the bidder must have properly completed at least 5 asphalt-concrete road construction works within the 60 months preceding the start of the procurement, each with an area of at least 2,000 m², and must submit client-signed confirmations. The bid must also include the project manager’s details and the document required on the form provided by the contracting authority; if qualification data are not available from public registers, the bidder must add the relevant documents proving the professional level or equivalent. In the case of a joint bid, a power of attorney from the joint bidders must be submitted. The bid must comply with all tender documents; conditional bids are not allowed, and equivalence must be explained and supported by evidence where necessary. The bid price must be submitted on the contracting authority’s form, with the unit price shown to the nearest cent and a zero price is not allowed.
