Compliance requirements
The tender documents include the standard exclusion grounds, especially criminal convictions such as participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its managers/representatives must confirm whether any such ground applies and, where relevant, provide the conviction date, reason, person concerned, exclusion period, self-cleaning measures, and electronic evidence details. If an exclusion ground exists, the bidder may be able to rely on self-cleaning measures if allowed by the procurement documents.
Qualification criteria and exclusion grounds
The bidder's total annual turnover for each of the last three completed financial years must be at least EUR 7,000,000. If the bidder relies on the resources of another company, a written commitment from that company and an ESPD for that company must also be submitted.
The person responsible for the construction works must hold at least the qualification of a chartered civil engineer, level 7, with specialisation in building construction and the selected additional competence of construction management, or an equivalent qualification. For this person, the bidder must provide the name, professional qualification and certificate number. If the qualification was issued outside Estonia, a copy of the certificate and confirmation from the competent Estonian authority that it meets the required qualification must be submitted.
Under the compliance requirements, the bidder must confirm that the tender complies with all conditions set out in the tender documents. The project team must meet the requirements in section 6.1.1 of Annex 1 to the technical specification, and specialists listed in section 7 of Annex 1 must be involved to coordinate the construction sub-disciplines, ensure quality control and manage the works. Their details must be submitted at least two weeks before the relevant works start.
The tender price must be submitted according to the specified structure and the price submission form in Annex 2 must be included. In the case of a joint tender, an authorised representative must be appointed and a joint tenderers' power of attorney must be attached. The bidder must also provide contact person details and confirm whether the tender contains trade secrets.
