Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the procurement documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also require electronically available evidence and references.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise qualification, suitability or technical capacity requirements; these must be checked in the procurement documents. The compliance conditions do, however, require the bidder to confirm that the bid complies with the procurement documents, provide equivalent-solution explanations and evidence where needed, and submit all required forms and confirmations. If this is a joint bid, a joint-bid authorisation must be attached. The bidder must also provide proof of the bid security or a guarantee letter and confirm compliance with environmental requirements and sanctions-related restrictions.
