Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or offences related to a terrorist act or terrorist activity. If any such ground applies, the bidder may submit a description of self-cleaning measures where permitted. The bidder must also confirm that it will not use a subcontractor in the performance of the contract if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must prove technical and professional capability with at least one significant works contract completed within the last 60 months. Acceptable references are: full construction or reconstruction of at least 15 km of drainage ditches in a land improvement system; or renewal or maintenance of at least 30 km of such ditches; or construction of at least 15 earthen dams in restoration works for bogs or mires. If the contracts were obtained through a public procurement procedure, the relevant reference number must also be provided. Where requested, the bidder must submit confirmation from the client or main contractor that the work was performed properly. If the bidder relies on the capacities of another company, the details and consent of that company must also be provided. In addition, the bidder must confirm a mandatory guided site visit before the tender is considered, confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, and that the price offer form has been fully completed.
