Compliance requirements
The tender documents include the standard exclusion grounds for criminal organisation, corruption and other mandatory grounds under the Public Procurement Act. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full list in the extracted text, so the exact exclusion grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must prove manufacturer authorisation to sell the contract subject matter and to provide product support in Estonia. Acceptable proof is a document copy or a link to the manufacturer’s and partner’s website. If the authorisation is granted in the EU or proven through a cooperation partner, that is also acceptable. When proving through a partner, two proofs are required: a manufacturer confirmation or website link showing the partner’s authorisation, and an additional partner confirmation or website link showing cooperation with the bidder.
The bid must remain valid for 4 months. Conditional bids are not allowed. The bidder must confirm that the bid complies with the tender documents and, where necessary, equivalence has been explained and supporting evidence has been attached.
The bidder must confirm that its place of residence or establishment, as well as that of any joint bidders and possible subcontractors, is in Estonia, another EU Member State, another EEA Agreement State or a country that has acceded to the WTO Government Procurement Agreement. If joint bidders participate, an authorised representative must be appointed. If subcontractors are used, by the start of contract performance the bidder must provide each subcontractor’s name, registration code, contact details, details of their legal representatives, and the subcontract agreement title, date, number and amount; the same applies to subcontractors added later.
If the bidder has persons whose authorisations are not shown in the business register, their first and last name, personal identification code and basis of representation must be provided so that the contracting authority can check exclusion grounds. The bidder must also provide the contract-signing and contact details if the bid is successful.
The bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian citizens, residents or entities established in Russia, or if they are more than 50% owned by such persons or entities, or act on their instructions.
