Compliance requirements
The bidder must confirm that neither it nor its management or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorism, child labour, human trafficking, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm payment of taxes and social security contributions and that the participants are established in the permitted countries. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
When submitting the bid, the bidder must confirm that the bid is valid for 4 months, unconditional, and compliant with the procurement documents. If equivalent products or services are offered instead of Ericsson items, equivalence must be explained and evidence attached. The bidder must have the manufacturer’s right to sell the contract subject matter and the right to provide product support in the territory of the Republic of Estonia; this may be evidenced by a manufacturer’s or partner’s confirmation or a website reference. If representation rights are evidenced through a partner, two proofs are required: a manufacturer’s confirmation of the representation right and a partner’s confirmation of cooperation with the bidder. In the case of a joint bid, an authorised representative must be named and a power of attorney for the joint bidders must be attached. The bidder must provide the company and signatory details needed for contract conclusion and confirm that it and, where relevant, joint bidders and subcontractors are established in the permitted countries. Subcontractor details must also be provided before contract performance starts.
