Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where permitted. The tender documents also include sanctions-related declarations: the bidder must confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value if they are Russian nationals, residents or entities established in the Russian Federation, or persons/entities owned or controlled by them. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The bid must be submitted without any prohibited corrupt conduct.

Qualification criteria and exclusion grounds

The bidder must have completed at least three contracts in the 36 months before the start of the procurement that demonstrate experience in providing marketing services similar to the subject of the contract. At least one of the three contracts must concern international marketing services for foreign markets and have a value of at least EUR 30,000 excluding VAT. At least two of the three contracts must concern domestic marketing campaigns in Estonia, and each of those two contracts must have a value of at least EUR 20,000 excluding VAT. Similar services include strategic planning of a marketing campaign and development of a creative concept. The bidder must submit an initial confirmation of the required experience in the ESPD and provide a list of the relevant contracts with contract period, description of the subject matter, validity dates, counterparty contact details and, where applicable, reference numbers. If a contract is still being performed, only the part already delivered and accepted by the contracting authority by the procurement start date may be used to prove experience. If the service was provided under a framework agreement, the bidder may rely on contracts/orders concluded and performed under that framework agreement. The creative director must have at least 3 years of work experience as a creative director during the six years before the start of the procurement, and a CV on the contracting authority’s form must be submitted. The remaining team members required by the technical specification must have their work experience and, where required, education details submitted before contract award. The bid must include the required sample task and the bidder must confirm that the bid follows the structure required for the bid price. The tender documents also require confirmation of compliance with the technical specification, equivalent solutions where relevant, and the required declarations and CV form.
