Compliance requirements

The contracting authority will exclude a bidder if the mandatory exclusion grounds apply to the bidder or to its management, supervisory or representative persons. These mandatory grounds cover convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement, aiding or attempt, money laundering and terrorist financing. They also cover convictions for enabling illegal employment of a foreign national staying in the country without legal basis or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, and convictions for illegal use of child labour or human trafficking-related offences. Another mandatory ground is tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached an essential term of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed, or if it has provided false information about compliance with qualification requirements or failed to submit required additional documents.

Qualification criteria and exclusion grounds

The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting party’s details and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance. The bidder must have a person in charge of electrical works with a valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act. This person must have the relevant certificate at the time of submission and must be entered in Elektrilevi’s partner portal before the opening of tenders. For switching operations related to the works in the 0.22–20 kV electricity network, the bidder must have an employee with switching authorisations. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching authorisations are required; in other cases, both low-voltage and medium-voltage switching authorisations are required. This person must be entered in Elektrilevi’s partner portal before the opening of tenders. The bidder must have a person designated as responsible for the work operation, and that person must be entered in Elektrilevi’s partner portal before the opening of tenders. The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must include a price table in the form required by the tender documents, and all unit price fields must be completed. The bidder must confirm that the tender complies with the conditions set out in the tender documents and that no conditional or additional tender has been submitted. The bidder must confirm the choice of the contracting authority’s standard payment term; if the bidder joins or has joined the contracting authority’s factoring programme, a 95-calendar-day payment term applies. The bidder must indicate which information is confidential business information and justify that designation. The tender price and other numerical indicators corresponding to award criteria may not be marked as confidential. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus. The bidder must confirm that materials, equipment and goods, including components, to be installed and used during the works are not produced in or originating from the Russian Federation or the Republic of Belarus. The contracting authority may request certificates of origin.
