The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption and other exclusion grounds listed in the ESPD. The ESPD also requires confirmation of the ability to provide proof of payment of taxes and social security contributions and, where relevant, information on measures taken to restore reliability. If an exclusion ground applies, it must be checked whether self-cleaning is allowed under the procurement documents and the Public Procurement Act.

The machine-readable notice did not include precise selection, suitability or compliance criteria; these must be checked in the procurement documents. The ESPD indicates that the bidder must, where relevant, provide information on joint bids, reliance on other entities and subcontractors, and confirm that the bid complies with the procurement documents. The compliance conditions also require a power of attorney for joint bidders if the bid is submitted jointly, and a document proving payment of the bid security or a guarantee letter meeting the tender document requirements.
