Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended or is not in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment. The bidder must confirm that its average wage during the reference period was above 70% of the average wage for the same period in the relevant field. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure. The bidder must also confirm that it is not a related party to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register for construction with the activity types general construction, indoor climate systems, and building internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. For foreign bidders, the register-entry requirement does not apply, but equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; it is sufficient if at least one joint bidder meets the requirement on its own.
Within the last 60 months, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT. A comparable project means a main-contractor project involving the erection, extension or full-building reconstruction of a building, where at least the following works were carried out: construction or reconstruction of the building’s load-bearing and external envelope structures, construction or reconstruction of a heat-recovery ventilation system, and construction or reconstruction of a heating system. To prove this, the bidder must provide the project name, timing, value, the nature of the work, and a reference to the occupancy notice or building permit number, or a copy of the handover-acceptance report signed by the client and contractor.
The team must include: a project manager with at least Level 6 construction engineer qualification or Level 6 construction manager qualification; a site manager with at least Level 5 construction site manager qualification; a ventilation and heating systems specialist with Level 6 qualification or Level 6 construction manager qualification in indoor climate systems; a water supply and sewerage systems specialist with Level 6 qualification or Level 6 construction manager qualification with the relevant specialisation; and, for electrical works, a person with a Class B competence certificate or Level 6 electrical engineer qualification. For each named person, the bidder must provide the name and the professional or competence certificate number. Equivalent competence is accepted for foreign bidders.
The bid must be submitted on the beneficiary’s form, must comply with the procurement documents, and conditional bids are not allowed. If a joint bid is used, a power of attorney for the joint bidders must be attached. If the bid is submitted by an authorised representative, a power of attorney must be attached. If equivalence is relied upon, supporting documents must be provided. If the bid contains trade secrets, they must be identified and justified. If team members are not the bidder’s employees, their written consent to participate must be attached to the bid documents.
The machine-readable notice did not include precise requirements for one additional specialist role; this must be checked in the official tender documents.
