Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in section 95(1) points 1–3 and 5 of the Public Procurement Act apply to it, taking section 95(2) into account.
The bidder must confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment.
The bidder must confirm that it has no tax, fee, environmental charge, tax debt or social security contribution debt under the law of its country of establishment.
The bidder must confirm that its average salary during the reference period was more than 70% of the average salary for the same period in the relevant field for the contract. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure.
The bidder must provide a Tax and Customs Board statement, or for a foreign bidder an equivalent certificate from a competent authority in its country, proving the salary condition. In a joint bid, the proof must be submitted for each joint bidder.
The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register for construction with the following activity areas: general construction, indoor climate systems, and indoor or associated water supply or sewerage systems. This registration requirement does not apply to a foreign bidder; in that case, equivalent proof of competence must be provided.
For electrical works, the bidder must have notified the Economic Activities Register under the activity area of electrical works, specifically construction and installation of electrical installations. This registration requirement does not apply to a foreign bidder; equivalent proof may be submitted.
The bidder's net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value, excluding VAT. The exact amount must be entered to the nearest euro.
The bidder must confirm that it can provide, by the contract date or within 10 calendar days after contract signature, a performance security equal to 5% of the contract value. A bank or financial institution guarantee is accepted, as is depositing the corresponding amount into the beneficiary's bank account or a notary account, provided the beneficiary remains the entitled party throughout the construction period. Joint bidders may meet this requirement together.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least 1 equivalent construction work with a value of at least half of the expected contract value excluding VAT. Equivalent work means construction of a building, extension of a building, or reconstruction of an entire building as the main contractor, and the work must have included at least one of the following: construction or reconstruction of load-bearing and external envelope structures, construction or reconstruction of a heat-recovery ventilation system, or construction or reconstruction of a heating system. The bidder must provide the name of the work, building details, time and value, indicate whether it was construction, extension or full reconstruction as main contractor, and confirm which of the listed works were included. Completion must be evidenced either by a handover-acceptance report signed by the client and contractor or by a reference to the building register notice or occupancy permit number.
The bidder's team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and with the competence of construction management, or a level 6 construction manager qualification specialising in general construction. A foreign bidder may nominate a person with equivalent competence. The person must be involved in the works and the bidder must provide the person's name and professional certificate number.
The bidder's team must include a site manager with at least level 5 construction foreman qualification specialising in general construction works. A foreign bidder may nominate a person with equivalent competence. The person must be involved in the works and the bidder must provide the person's name and certificate number.
The bidder's team must include a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification, with competence in managing construction of heating systems and ventilation systems, or a level 6 construction manager qualification specialising in indoor climate systems. A foreign bidder may nominate a person with equivalent competence. The person must be involved in the works and the bidder must provide the person's name and certificate number.
The bidder's team must include a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification, with competence in construction management, or a level 6 construction manager qualification specialising in indoor or associated water supply and sewerage systems. A foreign bidder may nominate a person with equivalent competence. The person must be involved in the works and the bidder must provide the person's name and certificate number.
For electrical works, the bidder's team must include a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. A foreign bidder may nominate a person with equivalent competence. The person must be involved in the works and the bidder must provide the person's name and certificate or qualification number.
