Compliance requirements

The machine-readable notice included standard exclusion grounds, including participation in a criminal organisation and corruption. The bidder or its management, supervisory or representative persons must not have a final conviction for these offences within the last five years, unless the exclusion period has already expired. If an exclusion ground exists, the bidder may be able to prove self-cleaning measures. The notice also refers to the possibility of checking whether the information is available electronically. Precise exclusion details must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must demonstrate experience in selling the offered products. During the last 3 years counted back from the publication of the contract notice, the bidder must have sold each product offered in this tender in a quantity of at least one third of the planned quantity set out in Annex 1 for the framework agreement period. To prove this, the bidder must submit a list of properly performed sales contracts or transactions, including contract dates, value, the other parties and the quantities sold. The bidder must also provide a confirmation in the ESPD. The bidder’s company must employ, or otherwise engage under a contractual arrangement, a product representative who has received manufacturer training for the offered products or has completed training for those products. Upon the contracting authority’s request, copies of certificates proving the training or the manufacturer’s written confirmation must be submitted. The bid must comply with the technical requirements. Annex 1 must be submitted in Excel format and must show the exact product name, manufacturer, product code or reference number, descriptions of all sub-items and the actual parameters. The bidder must also submit a document, or a copy of it, proving the right to sell the offered products in Estonia. If the bid is signed by someone other than the legal representative, a power of attorney must be submitted. In the case of a joint bid, a joint bidders’ power of attorney and a statement on joint and several liability must be submitted. The bidder must also submit the application and confirm that the bid complies with the procurement documents and, where necessary, that equivalence has been demonstrated and evidence has been attached to the bid documents.
