Compliance requirements
The tender documents include the standard exclusion grounds. A bidder must confirm that neither the bidder nor its management, supervisory or representative persons have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and other similar mandatory exclusion grounds set out in the procurement documents. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The exact list and any detailed conditions must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capability with at least one contract for the construction or reconstruction of an indoor climate control system completed within the 60 months preceding the start of the simplified procurement. The contract must have been completed during that period, and on request the contracting authority must be provided with a client certificate or a handover/acceptance report. If the bidder relies on the capacities of another entity, that entity’s ESPD and the required consent must also be submitted. The compliance conditions require confirmation that the bid complies with the tender documents, that conditional bids are not allowed, that a power of attorney must be provided for joint bids, and that the bid structure and cost list must be completed in the prescribed form. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
