Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD under the Estonian Public Procurement Act section 95. The bidder is asked whether the company or a person with management, representation or control powers has been finally convicted within the last five years. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures to restore reliability. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents or official tender details.
Qualification criteria and exclusion grounds
The bidder must submit a technical description of the offered product with all data required by the tender documents. To verify compliance, the bidder must provide the product name, specifications, datasheets and/or other information needed to check conformity. The bid must comply with the requirements set out in the tender documents, and equivalence must be demonstrated where necessary. If the offered goods or any subcontractors/suppliers are linked to Russia-related sanctions, the bidder must confirm that no more than 10% of the contract value will be performed by such persons or entities. In the case of a joint bid, a power of attorney from the joint bidders must be attached. If the bidder relies on the capacities of other entities or uses subcontractors, this must be declared accordingly. For authorised persons, the bidder must provide the name and personal identification code or date of birth if these are not visible from the commercial register.
