Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no insolvency or liquidation proceedings have been initiated against it, and that its business is not suspended. It must also confirm that it has no tax debt or social security contribution debt. In addition, the bidder must confirm that the average wage of its employees during the reference period was above 70% of the average wage in the relevant sector and provide an extract from the Tax and Customs Board or, for a foreign bidder, an equivalent certificate. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register under the activity of construction, with activity types covering general construction, indoor climate systems, and water supply or sewerage systems within buildings or attached to buildings. For a foreign bidder, an equivalent proof may be submitted instead of a register entry. The bidder must also hold a Heritage Board authorisation, or equivalent competence, allowing the design, conservation and restoration of buildings located on monuments or UNESCO World Heritage sites. For electrical works, the bidder must have the relevant electrical works registration or an equivalent proof. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value excluding VAT. The bidder must accept that, by the contract date or within 10 calendar days after signature, it must be able to provide a performance security equal to 5% of the contract value. The bidder must also prove at least one comparable construction project completed within the last 60 months; the project must have involved the erection, extension or full reconstruction of a building as the main contractor and included at least load-bearing structures and external envelope works, heat-recovery ventilation, and heating system works. The team must include a project manager with either a level 6 construction engineer or construction manager qualification, a project manager with a Heritage Board competence certificate, a site manager, a ventilation and heating systems specialist, and a water supply and sewerage systems specialist; for each role, the bidder must provide the person’s name and the qualification or competence certificate number. The tender must be submitted on the beneficiary’s form and comply with the procurement documents; conditional tenders are not allowed. If a joint tender is used, a power of attorney from the joint bidders must be attached and each joint bidder’s share must be stated. If the tender is submitted by an authorised representative, the relevant authorisation must be attached. If subcontracting or non-employee team members are used, the required consents must be attached. The machine-readable notice did not include precise requirements; they must be checked in the tender documents.
