Compliance requirements
The bidder must confirm that neither it nor any joint bidder is subject to exclusion grounds, including the grounds listed in section 95(1) points 1–3 and 5 of the Estonian Public Procurement Act. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, that its business activities are not suspended, and that it is not in any other similar situation.
The bidder must not have unpaid state taxes, fees or environmental charges, or unpaid tax or social security contributions under the law of its country of establishment. It must also confirm that its employees’ average salary during the reference period was higher than 70% of the average salary in the relevant sector for the same period, and this may need to be proven with a Tax and Customs Board statement.
In addition, the bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, exclusion grounds are checked separately for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the Register of Economic Activities for construction activities covering at least general construction, indoor climate systems, and indoor or adjacent water supply or sewerage systems. For electrical works, the bidder must also be registered for electrical works covering the construction, including installation, of electrical installations. For a foreign bidder, an equivalent proof of competence may be accepted instead of the registration.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. In addition, the bidder must be able to provide a performance security covering 5% of the contract value by the contract date or within 10 calendar days after signing; the security must remain valid throughout the construction period. A deposit of the corresponding amount to the beneficiary’s or a notary’s account is also accepted if the beneficiary remains the entitled party throughout the construction period.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one comparable construction project as the main contractor, with a value of at least half of the estimated contract value. The comparable project must have involved the erection, extension or full reconstruction of a building and must have included at least the construction or reconstruction of the load-bearing and external envelope structures, supply-air ventilation with heat recovery, and a heating system. The bidder must provide the project name, execution period, value, and proof such as the building register occupancy notice or use permit number, or a signed handover-acceptance certificate.
The bidder’s team must include a project manager, site manager, HVAC specialist, water supply and sewerage specialist, and a person involved in electrical works. The project manager must hold at least level 6 professional qualification as a building engineer specialising in building construction or level 6 construction manager qualification specialising in general construction. The site manager must hold at least level 5 construction foreman qualification specialising in general construction works. The HVAC specialist must hold at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage specialist must hold at least level 6 qualification as a water supply and sewerage engineer with the relevant management competence, or level 6 construction manager qualification specialising in indoor or adjacent water supply and sewerage systems. For electrical works, the involved person must hold at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. The names and certificate numbers of all these persons must be provided, and an equivalent qualification is accepted for a foreign bidder.
The bidder must have a quality management system in construction activities that meets at least EVS-EN ISO 9001, and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent requirements.
