Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, commission of a terrorist act or offences related to terrorist activity, or fraud. The bidder must also confirm that no subcontractor excluded under Section 122(7) of the Public Procurement Act will be used in performance of the contract. If an exclusion ground applies, the company may submit evidence of self-cleaning measures where permitted by law or the tender documents.

Qualification criteria and exclusion grounds

The bidder’s average annual turnover for the financial years ending within the last three years before the start of the procurement must be at least EUR 200,000. The turnover assessment period is 01/01/2022–31/12/2025. The bidder must also prove prior experience: within the 60 months before the start of the procurement, it must have built at least one pedestrian path, pedestrian and cycle path, or cycle path of at least 350 metres, including lighting; this may also be a sidewalk or pedestrian/cycle path built as part of the reconstruction of a road or street with shared lighting. The ESPD must include references to the relevant procurements or information on the contract partner, the length of the built path and the lighting. The bid must comply with the requirements in the procurement documents, and where equivalence is used it must be explained and supported by evidence.
