Compliance requirements
The bidder must confirm that neither it nor its managers or representatives have been finally convicted in the last five years for participation in a criminal organisation, corruption or fraud, and that any exclusion period in the judgment has expired. If an exclusion ground exists, the bidder may have to show self-cleaning measures and, where allowed, supporting evidence. The notice also refers to similar exclusion grounds in the tender passport and to sanctions-related restrictions: the bidder confirms that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents, entities established in the Russian Federation, entities more than 50% owned by them, or acting on their instructions. The machine-readable notice did not include more precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. For the road works, the person responsible for organising the construction works must have the professional qualification Road Engineer, level 6, specialisation in road construction and maintenance, selected competence: management of construction activities, or an equivalent qualification (EQF 6). The bidder must provide the responsible person's details in the tender passport and, if requested, a copy of the document proving the qualification. The notice also requires confirmation that the bid complies with the tender documents and that the bidder can submit the bill of quantities in the required structure. If the bidder relies on another company or uses subcontractors, it must provide powers of attorney or other supporting documents showing that those parties agree to the use of their resources and to perform the relevant contract work.
