Compliance requirements
The bidder must confirm that neither it nor members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. The same applies to the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use subcontractors or suppliers linked to the Russian Federation, within the meaning of the sanctions rules, for more than 10% of the contract value, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by that country's law, and a foreign bidder must provide proof of registration upon the contracting authority's request. The bidder must prove that, within the 24 months preceding the publication of the contract notice, it has properly performed at least two similar works contracts consisting of the design and construction of a solar power plant and storage system with a capacity of at least 15 kW. For each such contract, the bidder must provide a description and a reference that allows the contracting authority to verify the experience, and, in the case of a public procurement, the procurement reference number. The bidder must employ at least one person holding a level 7 certified electrical engineer qualification with design competence indicated on the certificate; a copy of the certificate must be attached.
