Complete reconstruction works for the apartment building of the Haapsalu, Rüütli 3 apartment association (EIS)

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that its business has not been suspended, and that it has no tax or social security contribution debts. The bidder must also confirm that the average salary of its employees during the reference period was above 70% of the sector average for the same period and provide an extract from the Tax and Customs Board or, for a foreign bidder, an equivalent certificate. In addition, the bidder must confirm that it is not a related party to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint bid, the exclusion grounds are checked for each joint bidder separately.

The bidder must have filed a notice in the business register for the construction activity area covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a notice for the electrical works activity area covering the construction, including installation, of an electrical installation. The registration requirement does not apply to a foreign bidder, but equivalent competence must be demonstrated. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT; in a joint bid, turnover may not be aggregated and the requirement must be met by at least one joint bidder on its own. The bidder must have carried out at least one equivalent construction project as main contractor during the last 60 months, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must have involved the erection, extension or full reconstruction of a building and at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a heating system. Proof must be provided by a building register occupancy notice or building permit number, or by a handover-acceptance report signed by the client and contractor. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a competent person; for each role, the name and professional or competence certificate number must be provided. The bidder must confirm acceptance of the 5% performance security requirement and confirm that the bid complies with the procurement documents and, where relevant, that equivalence has been explained and evidenced. If team members are not employees of the bidder, their written consent to participate must be attached. The bid must be submitted on the beneficiary’s form and conditional bids are not allowed. In a joint bid, a power of attorney must be attached and each joint bidder’s share must be stated.
