Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that insolvency or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, duty, environmental charge, tax debt or social security contribution debt under the law of its country of establishment. In addition, the bidder must confirm that it is not a related person to the technical consultant Urmo Kaasik. For a joint tender, these checks apply to each joint bidder. The machine-readable notice also required proof of average employee pay above 70% of the sector average during the reference period, but the exact proof procedure must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must have submitted, in the Register of Economic Activities under the activity area "Construction", a notice covering general construction, indoor climate systems, and building internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a notice under the activity area "Electrical works" for the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but such bidder must prove its competence with an equivalent document where relevant. The bidder's net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value excluding VAT; the exact amount must be entered to the nearest 1 euro. The bidder must provide details of at least one equivalent construction contract performed during the last 60 months. That contract must have been a construction of buildings, an extension, or a full-building reconstruction as the main contractor, and it must have included at least construction or reconstruction of the building's load-bearing structures and external envelope, forced ventilation with heat recovery, and heating system works. To prove performance, the bidder must provide the number of the occupancy notice or occupancy permit in the building register, or attach a copy of the handover and acceptance report signed by the client and contractor. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a qualified person for electrical works. For each role, the bidder must provide the person's name and the number of the professional or competence certificate. The project manager must have at least Level 6 construction engineer qualification with a specialization in building construction, or Level 6 construction manager qualification with a specialization in general construction. The site manager must have at least Level 5 construction work manager qualification with a specialization in general construction works. The ventilation and heating systems specialist must have at least Level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or Level 6 construction manager qualification with a specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least Level 6 qualification as a water supply and sewerage engineer, or Level 6 construction manager qualification with a specialization in the construction of building internal or associated water supply and sewerage systems. For electrical works, the person involved must have at least a Class B competence certificate or a Level 6 electrical engineer qualification in consumer electrical installations. All these persons must be involved in the performance of the works.
