Compliance requirements

The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been opened against it, or if its business activity has been suspended. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debt, or tax or social security contribution debt, unless the debt has been deferred or paid within the required time limit. In addition, the exclusion grounds listed in section 95(1)(1–3 and 5) of the Public Procurement Act must not apply, and the bidder and the technical consultant must not be related persons. If the contracting authority cannot verify the conditions from public registers, it may request evidence.

Qualification criteria and exclusion grounds

The bidder must have a business activity notice in the field of construction for general building works, indoor climate systems, and internal or associated water supply or sewerage systems. When carrying out electrical works, the bidder must also have a business activity notice in the field of electrical works for the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. By the time the contract is signed, the bidder must be able to provide a 5% performance security; the security must remain valid throughout the construction period. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and the person performing electrical works, each with the required qualification or competence certificate. During the previous 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value; the equivalent project must include, among other things, construction or reconstruction of the load-bearing structure and external envelope, forced ventilation with heat recovery, and a new heating system. The bidder must have a quality management system compliant with EVS-EN ISO 9001 and an environmental management system compliant with EVS-EN ISO 14001, or equivalent.
