Compliance requirements
The bidder must be excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, if its business activities are suspended, or if it is in a similar situation. Another exclusion ground is tax, fee or environmental charge arrears, or arrears of tax or social security contributions, unless the debt has been deferred or paid within the required time limit. The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply and that it is not a related person to the beneficiary’s technical consultant. If the checks cannot be made from public registers, the relevant evidence must be submitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the Business Register under the activity area ‘Construction’ for general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a Business Register notification under the activity area ‘Electrical works’ for the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove equivalent competence. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able to provide a performance security, confirmed by a credit or financial institution, in the amount of 5% of the contract value; the security must remain valid throughout the construction period and may also be provided by depositing the corresponding amount. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and the person performing electrical works, each with the required professional qualification or competence certificate. The bidder must submit at least one reference for an equivalent construction project completed within the last 60 months; the reference must be worth at least half of the estimated contract value and must cover the construction, extension or full-scale reconstruction of a building as the main contractor, including load-bearing structures and external envelope works, heat-recovery ventilation, and heating system construction or reconstruction. The tender must be submitted in the form required by the tender documents and in full; if business secrets are involved, they must be clearly marked. If the required evidence is not submitted with the tender and cannot be verified from registers, the contracting authority may grant 10 calendar days to remedy the deficiency.
