Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other persons authorised to represent or control the bidder have been finally convicted within the last five years for participation in a criminal organisation, corruption or any other exclusion grounds named in the tender documents. If such a ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted.
The compliance conditions include a separate sanctions requirement: the bidder confirms that it will not involve subcontractors or suppliers for more than 10% of the contract value in contract performance if they are Russian citizens, residents or entities established in the Russian Federation, or if they are more than 50% owned by such persons or entities, or act on their instructions. The contracting authority will reject a bid if the resulting contract would be void due to sanctions rules. The machine-readable notice did not include any more precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s average annual total net turnover for the last three financial years (2023, 2024, 2025) must be at least EUR 300,000 per year, i.e. at least EUR 900,000 in total. If the bidder has been active for less than three years, the average turnover is calculated for the period of activity. If the bidder relies on the capacities of other entities, the relevant details for those entities and their consent to the reliance must also be provided.
Within the 36 months before the publication date of the contract notice, the bidder must have performed at least 1 design assignment as the main contractor at least up to the preliminary design stage. The assignment must have concerned an office building or an entertainment, educational, healthcare or other public building with a closed net area of more than 2,500 m². The notice specifies that in Estonia such buildings are buildings with codes 12200 and 12600.
The bid must confirm that it complies with the requirements set out in the procurement documents and, where necessary, that equivalence has been explained and evidence of equivalence has been attached. The bid price must be submitted in the required structure. If a joint bid is submitted, a power of attorney for the joint bidders must be attached. Where the tender documents refer to evidence or data, the bidder must provide the required proof or indicate electronic availability. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents.
