Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, or offences related to committing a terrorist act or terrorist activity. The bidder must also confirm that it is not subject to sanctions and that the goods offered do not originate from sanctioned regions. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For authorised persons, the bidder must provide the name and personal identification code, or confirm that no such persons exist. The machine-readable notice did not set out all exclusion grounds in precise detail; they must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 100,000. Joint bidders may combine turnover figures. If the bidder relies on the resources of another entity, the bidder must also provide that entity’s details and, where required, its consent confirming that it allows reliance on its turnover, will provide financial resources for contract performance, and will be jointly liable for performance of the part of the contract for which its resources are relied upon. For technical capacity, the bidder must provide a list of contracts meeting the contracting authority’s specified characteristics and completed within the 36 months preceding the start of the procurement; the tender text mentions, as an example, maintenance and emergency works for air-conditioning systems, together with the contract term and value data. The machine-readable notice did not include precise selection or compliance requirements; they must be checked in the procurement documents.
