Compliance requirements

The bidder must confirm that none of the exclusion grounds under section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been opened against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, or social security contribution arrears under the law of its country of establishment. In addition, the bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. For a joint bid, each joint bidder is treated as a bidder and the exclusion grounds are checked for each of them. The machine-readable notice did not include any more precise exclusion requirements; these must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice for electrical works covering the construction, including installation, of an electrical installation. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, this condition is met if at least one joint bidder meets it on its own; turnover may not be aggregated. The bidder must have completed at least one equivalent construction project within the 60 months before the procurement procedure started. The project must have been worth at least half of the estimated contract value excluding VAT and must have involved building erection, extension and/or full-building reconstruction as the main contractor. The equivalent project must have included at least: construction or reconstruction of the building’s load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a heating system. The bidder must provide the project name, building details, time and value without VAT, indicate whether it was erection/extension/full reconstruction as main contractor, and confirm the included works. Proof may be given by a reference to the occupancy notice or occupancy permit number in the building register, or by attaching a copy of the handover-acceptance act signed by the client and contractor. The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction with the competence to manage construction activities, or level 6 construction manager qualification specialising in general construction. The team must also include a site manager with at least level 5 construction site manager qualification specialising in general construction works, a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification specialising in indoor climate systems, a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification specialising in internal water supply and sewerage systems, and, if electrical works are performed, a person with the required electrical competence. For each named specialist, the bidder must provide the person’s name and professional certificate number. Foreign bidders may use equivalent competence evidence. The bidder must also be able to provide a performance security equal to 5% of the contract price by the contract date or within 10 calendar days after contract signing. The security may be provided by a credit or financial institution, or by depositing the amount to the beneficiary’s or notary’s account under the stated conditions.
