Compliance requirements
The bidder must confirm that neither it nor its representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or the other exclusion grounds listed in the ESPD. The ESPD also contains questions on terrorist offences, money laundering, tax arrears, labour-law breaches and other statutory exclusion grounds; the exact grounds must be checked in the tender documents. If an exclusion ground applies, the bidder may provide a description of self-cleaning measures, if permitted. The bidder must also confirm that neither it nor its subcontractors are established in the Russian Federation or the Republic of Belarus, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
Qualification criteria and exclusion grounds
The bidder must have performed at least 1 telecommunications service contract or other similar service contract within the 36 months before the start of the procurement, with a value of at least EUR 60,000 excluding VAT. Information on the contract period, value and the other contracting party must be provided; the contracting authority may also request confirmation from the other contracting party that the contract was performed properly. If the bid is submitted as a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bid must comply with the procurement documents, conditional bids are not allowed, and the required fields in the technical specification must be completed. Where equivalent solutions are used, equivalence must be explained and evidence must be attached. If the bid refers to standards or other requirements, equivalence must be shown where necessary. The required forms must also be completed, including the bid price submission form and the technical specification forms.
