Compliance requirements
The bidder and its management or representative body members must not have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted.
The bidder also confirms compliance with sanctions rules: it must not involve subcontractors or suppliers worth more than 10% of the contract value if they are citizens, residents, or entities established in the Russian Federation, or persons or entities owned or controlled by them or acting on their instructions. The bidder also confirms that it will not involve a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
If the bid is a joint bid, a authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm that the bid does not contain information that may be marked as trade secret under the law, and that the bid is submitted without conditions.
