Compliance requirements
The bidder and its management or representative body members must not have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted.
The bidder also confirms compliance with sanctions rules: it must not involve subcontractors or suppliers worth more than 10% of the contract value if they are citizens, residents, or entities established in the Russian Federation, or persons or entities owned or controlled by them or acting on their instructions. The bidder also confirms that it will not involve a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
If the bid is a joint bid, a authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm that the bid does not contain information that may be marked as trade secret under the law, and that the bid is submitted without conditions.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register or an equivalent register in its country of establishment, if required by law there. A foreign bidder must provide evidence of registration if requested by the contracting authority.
The bidder’s total turnover for the last three financial years ended by the time the procurement started must be at least EUR 150,000. The contracting authority may request an extract from the annual reports or other documents proving the turnover.
During the last 3 years, the bidder must have at least 2 previous contracts related to owner’s supervision for the construction and/or reconstruction of gravity wastewater or stormwater sewer pipelines. For each contract, the bidder must provide the period, client, contract value and public procurement reference number. The required experience must include supervision of the construction of at least 300 m of a De400 gravity wastewater or stormwater sewer pipeline.
The bid must comply with the conditions set out in the procurement documents, and where necessary, equivalence explanations and proof of equivalence must be attached. If the bidder relies on the resources of another entity, that entity’s ESPD and a signed consent for the use of its resources in performing the contract must also be submitted.
