Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators, or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value who are citizens, residents or entities established in the Russian Federation, or persons or entities owned or controlled by them. A bid that would result in a contract void under sanctions rules will be rejected.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment; a bidder established in Estonia must be registered in the Estonian business register, and a foreign bidder must provide evidence of registration if such registration is required in its country of establishment. For technical and professional capacity, the bidder must have properly performed similar passenger transport service contracts during the 36 months preceding the start of the procurement, with a total value of at least EUR 20,000 excluding VAT. Ongoing framework-type service contracts may be counted to the extent that services have actually been provided. Joint bidders may combine their experience figures. The bidder must provide details of the completed contracts in the ESPD and, where applicable, the details and consent of another entity if it relies on that entity’s resources.
