Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation, and that it has no tax or social security debt. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the average salary in the relevant sector and that the bidder is not a related person to the beneficiary’s technical consultant. In a joint bid, the exclusion grounds are checked for each joint bidder. The exact verification procedure and evidence must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the Economic Activities Register under the activity of construction, with activity types covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, a registration for electrical installation construction is also required; foreign bidders may prove equivalent competence instead. The net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must agree to provide a 5% performance security by the contract date or within 10 calendar days after contract signature. Within the last 60 months, the bidder must have completed at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT; the comparable project must involve the construction, extension or full reconstruction of a building as the main contractor and must include at least the construction or reconstruction of load-bearing structures and external envelope, mechanical ventilation with heat recovery, and heating system works. The team must include a compliant project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, a competent person for electrical works, and a chartered architect responsible for compliance with the New European Bauhaus requirements; for each role, the name and the professional or competence certificate number must be provided. The bid must be submitted on the form required in the tender documents, and conditional bids are not allowed.
