Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, a terrorist offence or another terrorism-related offence. If such a ground applies, the bidder may submit evidence of self-cleaning measures where allowed by the procurement. The machine-readable notice did not fully set out the precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another relevant register under the law of its country of establishment. To provide the security service, the bidder must hold the required licence: a valid licence issued by the Police and Border Guard Board for guarding and for the design, installation and maintenance of alarm systems. The bidder must have professional liability insurance of at least EUR 1,000,000 and submit a copy of the policy. For technical capacity, the bidder must have at least 3 years of experience in providing a similar security service and at least 3 properly and timely performed public contracts in the last 3 years. In the ESPD, the bidder must provide a list of those contracts with values, signing dates and performance deadlines. The compliance conditions also require a joint bidders’ power of attorney, confirmation that the tender complies with the tender documents, a price offer according to Annex 3, disclosure and justification of trade secrets, and confirmations concerning qualified personnel, the maintenance technician’s arrival within 2 hours in case of a fault, the age of the patrol vehicle, and other points named in the tender documents.
