Compliance requirements

The machine-readable notice included only a domestic exclusion ground: the contracting authority may exclude an economic operator if, because of its place of residence or establishment, it is not allowed to submit a tender or request to participate. The bidder must confirm this. Any other precise exclusion grounds must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have had annual net turnover of at least EUR 350,000 in each of the last three completed financial years (2023, 2024 and 2025). The contracting authority checks turnover from a public database; if the information is not available there, the bidder must provide documentary evidence or a confirmation with the tender. The bidder must have carried out at least one construction project similar to the contract subject within the 60 months before the start of the procurement. At least one reference building must have a built-up area of at least 500 m². The reference work may have started before that 60-month period, but it must have been completed and handed over to the client during that period. The bidder may have performed the reference work as main contractor, joint bidder or subcontractor, provided it was responsible for the similar works in substance. Similar works mean design-and-build projects delivered as a turnkey solution for a repair, production, warehouse or other comparable technical building. For each reference contract, the bidder must submit Form 1 with at least the contract subject description, performance period, client name and contact details, and confirmation that the work was performed properly. The bidder must have a project manager with a higher education in construction and at least Construction Manager, level 7 professional qualification. The bidder must provide confirmation of compliance and the project manager’s details in Form 1. If the contracting authority cannot verify the education or qualification from public registers, the successful bidder must submit supporting documents before contract signature within the deadline set by the contracting authority. The bidder must have a site manager for the construction works, with a higher education in construction and at least Construction Manager, level 6 professional qualification, who will be present on the construction site for the time needed to perform the site manager’s duties properly. The bidder must provide confirmation of compliance and the site manager’s details in Form 1. If the contracting authority cannot verify the education or qualification from public registers, the successful bidder must submit supporting documents before contract signature within the deadline set by the contracting authority. The bidder must hold a valid activity notice in the Register of Economic Activities for the activity area “Construction”, or an equivalent registration or licence under the law of its country of establishment. A bidder established outside Estonia must provide proof of the right to operate in that field under its home-country law. The machine-readable notice also requires confirmation that the bid complies with the tender documents, that the bid price is submitted in the required structure, that any equivalence is explained and supported by evidence if needed, and that the bidder has visited the site before submitting the tender.
