Compliance requirements
The contracting authority will exclude a bidder if a ground for exclusion under Section 95(1) or Section 95(4)(8) of the Public Procurement Act applies. The bidder must confirm that no such exclusion ground exists. If subcontractors are used, the same exclusion checks also apply to subcontractors during contract performance.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least 2 owner’s supervision contracts for water supply and sewerage system construction works, including reconstruction works, within the 3 years preceding the publication of the contract notice. Under one contract, supervision must have covered at least 1,000 m of pipeline construction, and under the other at least 300 m of pipeline construction. The bidder’s average net turnover for the last 3 completed financial years must be at least EUR 200,000. The bidder must submit the form listing similar completed contracts, turnover data, and the key persons form. The team must include at least an owner’s supervision specialist acting as project manager, an owner’s supervision specialist for electrical and automation works, and an owner’s supervision specialist for general construction works, each with the required professional certificates or equivalent certificates. The bid must comply with the tender documents, conditional bids are not allowed, equivalence evidence must be provided where necessary, and in the case of a joint bid a power of attorney for the joint bidders must be included. The bidder must also confirm completion of the price form and that no subcontractor subject to replacement is engaged.
