Compliance requirements
The bidder must be excluded from the procurement procedure if any of the exclusion grounds listed in Section 95(1) points 1–5 of the Public Procurement Act apply to the bidder or its representative. This includes convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or financing of terrorism; enabling illegal employment of a foreign national or breaching wage requirements; illegal use of child labour or trafficking in human beings; tax, fee or environmental charge arrears; or a breach of international sanctions or sanctions imposed by the Government of the Republic.
The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another similar register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself.
The bidder, a joint bidder and/or its subcontractor must have completed at least one contract similar to the subject of the tender within the 36 months before the start of the procurement, related to the preparation of an electrical design. Form 2, the list of contracts, must be submitted together with the dates of the contracts and the other contracting parties.
For the performance of the work, there must be a qualified responsible person: the person leading the electrical installation design work must have Class B competence with the competence area “Design” or a professional certificate “Electrical Engineer, level 6” with the competence area “Design”, or an equivalent or better qualification. A foreign bidder must submit copies of documents proving competence issued under the laws of its country of establishment and, if applicable, a confirmation that within one month after signing the contract it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the competence of the above-mentioned responsible person.
The bid must comply with the conditions set out in the procurement documents, and the bid price must be submitted in the structure prescribed on Form 1. If the bidder marks information as trade secret, it must briefly describe and justify it; the bid price and other numerical indicators related to evaluation may not be marked as trade secret.
