Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing. If a ground for exclusion exists, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment, and the contracting authority may require proof of registration. As regards technical and professional capacity, the bidder must have completed at least one contract for waterworks related to a port structure, such as a quay, pier, slipway or in-water platform, within the last 60 months. The work may have started earlier, but it must have been completed by the day the contract notice was published. The bidder must provide details of the similar work, including the work title, client details, total amount, its own scope of responsibility and the period. In addition, the bidder must provide details of the person responsible for the construction works; that person must have qualifications equivalent to a certified hydrotechnical engineer, level 7, specialising in management of construction activities, or equivalent competence. According to the compliance requirements, the tender must comply with all tender documents, conditional tenders are not allowed, and in the case of a joint tender a power of attorney must be submitted. It must also be confirmed that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act will be used in performing the contract.
