Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2) as well. The bidder must not be bankrupt or in liquidation, no bankruptcy or liquidation proceedings may have been initiated against it, and its business must not be suspended or in any similar situation.
The bidder must not have debts for state taxes, charges or environmental fees, or debts for tax or social security contributions under the law of its country of establishment. It must also confirm that its employees’ average salary during the reference period was higher than 70% of the average salary for the same period in the relevant field of the contract; a foreign bidder must provide evidence from a competent authority equivalent to the Tax and Customs Board. In a joint tender, evidence must be submitted for each joint bidder.
The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. The exact exclusion grounds and the procedure for checking them should be verified in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must be registered in the Register of Economic Activities under the activity area ‘Construction’ with the activity types of general construction, indoor climate systems, and water supply or sewerage systems inside or attached to a building. For electrical works, the bidder must have the activity area ‘Electrical works’ in the register and the right to construct, including install, electrical installations. For a foreign bidder, an equivalent proof may be submitted instead of the register entry.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint tender, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own.
Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means a main contractor project for the erection, extension or full reconstruction of a building, where at least the following works were carried out: construction or reconstruction of the load-bearing structure and external envelope, construction or reconstruction of a heat-recovery ventilation system, and construction or reconstruction of a heating system. To prove this, the bidder must provide the project name, timing, value, information on the scope of works, and a reference to the occupancy notice or building permit number, or a copy of the handover-acceptance certificate.
The team must include a project manager with at least Level 6 professional qualification as a construction engineer specialising in building construction, or Level 6 qualification as a construction manager specialising in general construction; a site manager with at least Level 5 qualification as a construction work manager specialising in general construction works; a ventilation and heating systems specialist with at least Level 6 qualification as a heating, ventilation and cooling engineer, or Level 6 qualification as a construction manager specialising in indoor climate systems; a water supply and sewerage systems specialist with at least Level 6 qualification as a water supply and sewerage engineer, or Level 6 qualification as a construction manager specialising in the construction of water supply and sewerage systems inside or attached to a building; and a person involved in electrical works with at least a Class B competence certificate or Level 6 qualification as an electrical engineer in consumer electrical installations. For each role, the name and the number of the professional or competence certificate must be provided.
In addition, the bidder must submit the price form, a power of attorney for joint bidders if applicable, proof of representation authority, a description of any business secret or a statement that there is no business secret, and documents proving equivalence where equivalent solutions are used. If team members are not employees of the bidder, their written consent to be involved must be attached.
