The bidder must confirm that neither it nor its management, supervisory or controlling body members, procurators or other authorised representatives have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the ESPD. If an exclusion ground exists, it may be possible to demonstrate self-cleaning where permitted. Under the compliance conditions, the bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are Russian citizens, residents or Russian-established businesses, entities more than 50% owned by them, or persons/entities acting on their behalf or under their instructions. The bidder must also confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.

The bidder’s average annual net turnover in the field related to the contract must be at least EUR 3,000,000 over the last 3 completed financial years for the period 01/01/2023–31/12/2025. The bidder must have completed at least 2 similar works as the main contractor within the 60 months preceding the start of the procurement. Similar works mean the construction of a new building or the substantial reconstruction of an existing building, including the creation of rooms suitable for food hygiene or laboratory requirements together with the management of the installation of special technical systems and technological equipment. Each reference project must have a closed net floor area of at least 800 m². The bidder must provide a list of completed contracts with their value, dates and the contact details of the other contracting parties. The ESPD must also include any other required evidence and data if specified in the tender documents.
