Compliance requirements
The bidder must confirm that neither it nor its management, supervisory or controlling body members, procurators or other authorised representatives have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the ESPD. If an exclusion ground exists, it may be possible to demonstrate self-cleaning where permitted. Under the compliance conditions, the bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value who are Russian citizens, residents or Russian-established businesses, entities more than 50% owned by them, or persons/entities acting on their behalf or under their instructions. The bidder must also confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
