Compliance requirements
The bidder must confirm that neither it nor members of its management, supervisory or administrative bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. The same logic applies to the other exclusion grounds listed in the ESPD, including terrorism, money laundering, child labour, tax debts and other cases provided for by law. If an exclusion ground applies, the bidder may in certain cases submit evidence of self-cleaning measures, where this is allowed by the tender documents or by law. The bidder must also confirm that it does not use prohibited subcontractors or suppliers in contract performance and that the goods offered are not subject to international sanctions.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment; a bidder registered in Estonia does not need to provide separate proof if the data are available from the commercial register. The bidder’s average annual net turnover from road construction works for the last three years (01/01/2023–31/12/2025) must be at least EUR 150,000 per year, and extracts from annual accounts must be provided if the data are not available from a public register. The bidder must have at least 1 previous public road repair reference from the last three years; the combined construction value of the submitted contracts must be at least EUR 150,000 excluding VAT. The bidder must describe at least one contract with a short description, performance period and client contact details, and must provide evidence of proper performance if requested by the contracting authority. A project manager with at least level 6 certified road engineer qualification in the road construction and maintenance specialisation must be involved in carrying out the works. The tender must be submitted in the structure set out in the tender documents, and conditional tenders are not allowed.
