Compliance requirements

The tenderer must confirm that neither the tenderer, nor a joint tenderer, nor another entity relied on has any exclusion grounds under § 95(1)(1), (4) and (5) of the Public Procurement Act. The contracting authority excludes tenderers who have been convicted of participation in a criminal organisation, breach of integrity duties or corruption, fraud, a terrorist offence or related offences, money laundering or terrorist financing, or who have tax or social security debts, or who are subject to international sanctions.

Qualification criteria and exclusion grounds

The tenderer must have, within the 60 months before the start of the procurement, successfully carried out similar design and construction works as the main contractor. Similar work means design and construction of at least one warehouse, accommodation building (including a barracks), public building or office building with a closed net floor area of at least 1,500 m². For the low-voltage works, the tenderer, a joint tenderer or a subcontractor must hold a State Secrets processing permit issued by the Estonian Internal Security Service at confidentiality level CONFIDENTIAL or higher, and a conformity certificate for the processing system issued by the Estonian Foreign Intelligence Service at the same level or higher. The tenderer must involve responsible persons with valid professional qualifications: a chief project manager who is a level 7 or higher certified civil engineer specialising in building construction with competence in construction management; a design manager who is a level 7 or higher certified civil engineer specialising in building construction with competence in design management; a site manager who is a level 6 or higher civil engineer specialising in building construction with competence in construction management; a person responsible for low-voltage works who is a level 6 security systems designer with competencies in alarm systems, surveillance systems and fire alarm systems design and who also has, by contract award, a State Secrets access permit at confidentiality level CONFIDENTIAL or higher; and a person responsible for high-voltage design who holds either an electrical A-competence certificate or is a level 7 certified electrical engineer specialising in electrical installations with design competence. If the tenderer relies on another entity’s capacities, it must provide that entity’s written and signed consent and show that the entity will participate directly in the performance of the contract in the part relied upon. The tenderer must also submit the details of the responsible persons and the validity information of the State Secrets access permits on the required form.
