The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–5 of the RHS apply. This means that neither the company nor its management or representative persons may have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, or human trafficking; there must also be no tax arrears or risk of breaching international sanctions. The bidder must also confirm that it has reviewed the rules and instructions on the contracting authority’s website.

The bidder must be entered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will verify the data itself. A foreign bidder must submit a valid copy of the registration certificate if its national law requires registration. The machine-readable notice did not include any other precise qualification, suitability or financial requirements; these must be checked in the tender documents.
