Compliance requirements
The bidder must confirm that neither the bidder nor members of its management, administrative or supervisory bodies have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activities, money laundering, child labour or other exclusion grounds named in the tender documents. If an exclusion ground exists, the bidder may in certain cases submit evidence of self-cleaning measures to restore reliability.
The bidder must also confirm that it does not use subcontractors who would have to be replaced under Section 122(7) of the Public Procurement Act, and that subcontractors or suppliers representing more than 10% of the contract value are not citizens, residents or entities established in the Russian Federation, or persons/entities controlled by them. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or professional register of its country of establishment, if required by that country’s law, and must provide a valid registration certificate or a copy of it if the information is not publicly available to the contracting authority. For a legal entity registered in Estonia, this requirement does not apply if the data are available from a public register.
The bidder’s average annual net turnover over the last three financial years in the field related to the subject matter of the contract, namely project management services, must be at least EUR 15,000 per year. The bidder must provide the relevant data in tender form IV.
Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least 3 contracts for managing projects in the water and sewerage sector, acting as the client’s representative or as project manager. The bidder must submit the information in form V, including the contract description, value, period and client details.
The tender must comply with the procurement documents, and if necessary the bidder must explain equivalence and attach evidence of equivalence. The completed tender forms I–VI must be submitted with the tender.
