Compliance requirements
The bidder must confirm that neither it nor members of its management, administrative or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of trafficking in human beings, fraud, or offences related to the commission of a terrorist act or terrorist activity. If such a ground exists, it may be possible to submit evidence of self-cleaning, if allowed by the procurement documents or by law. In the ESPD, answers must also be given on the date of conviction, the reason, the convicted person, the duration of exclusion and whether the information is electronically available. The exact exclusion grounds and any exceptions must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capability with at least one previous construction reference that meets the contracting authority’s volume requirements. The required experience must have been gained within the 60 months preceding the start of the procurement, either as the main contractor or as a subcontractor carrying out or organising all construction works.
Either of two alternatives is acceptable:
- fully completed or fully reconstructed, under a land improvement system construction project, at least 20 km of ditches, at least 50 culverts with a diameter of at least 400 mm, and at least 6 km or 30,000 m2 of roads; or
- land improvement system renewal or maintenance covering at least 100 km of ditch restoration, at least 250 culverts with a diameter of at least 400 mm maintained, and at least 6 km or 30,000 m2 of roads fully constructed or reconstructed.
The bidder must provide in the ESPD data on the relevant completed construction contracts. The contracting authority may also request a list of the main contracts and a confirmation from each contract’s client that the work was performed properly. The bid must comply with the procurement documents and, where necessary, equivalence must be demonstrated. Exact form and evidence requirements must be checked in the procurement documents.
