Compliance requirements
The bidder, or members of its administrative, management or supervisory body, procurators or other persons authorised to represent it, must not have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. In the ESPD, the bidder must also answer whether this information is electronically available and, if needed, provide the URL, code and issuing body. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. For a bidder established in Estonia, the contracting authority checks registration through the commercial register; a bidder established abroad must provide proof of registration if such registration is required in its country of establishment. The bidder’s average annual net turnover for the last three completed financial years must be at least EUR 60,000 per year for the period 01/01/2022–31/12/2024. If the bidder has operated for less than three years, the arithmetic average net turnover for the operating period must also be at least EUR 60,000. If the bidder submits a tender for both lots, the average turnover must cover the sum of the minimum turnover requirements for both lots. The bidder confirms compliance in the ESPD and the contracting authority may request additional evidence if needed. The tender must comply with all conditions set out in the procurement documents, and the capital lease payment schedule must be submitted in the required structure.
