Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators, or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or other exclusion grounds listed in the ESPD, and that any exclusion period stated in the conviction still applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. If necessary, the bidder must provide details of authorised persons who are not visible from the commercial register extract, or confirm that no such persons exist. In a joint bid, a power of attorney for the appointed representative must be submitted. The bidder must also confirm that it will not use subcontractors who would have to be replaced under Section 122(7) of the Public Procurement Act.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 65,000 excluding VAT. Joint bidders may combine their turnover. If the bidder relies on another entity’s resources, the details of that entity and, where required, its consent and supporting evidence must also be provided. Within the 36 months before the start of the procurement, the bidder must have performed at least one contract that included a road-related study with a value of at least EUR 25,000 excluding VAT. If requested, the bidder must provide the client’s confirmation of the contract scope, value and completion deadline. If experience is relied on through another entity’s resources, the details of that entity and its consent must also be provided. At least two key persons must participate in contract performance: a lead key expert with at least a master’s degree-equivalent higher education in construction, and a key expert responsible for analysing measurement results with prior experience in research and development work on road construction materials or road structures, road construction technical expertise, or geotechnical expertise. The bidder must confirm that it can use, or obtain access to, a suitable room for carrying out the study. The bid must also include the completed HD IV price breakdown and the required confirmations and authorisations.
