Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, or terrorist offences. It must also confirm that no current exclusion period applies. If an exclusion ground exists, self-cleaning measures may be submitted where permitted. In addition, the bidder must confirm that it will not use a subcontractor subject to replacement under Section 122(7) of the Estonian Public Procurement Act and that it will not engage subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, as required by the sanctions rules.
Qualification criteria and exclusion grounds
The bidder must prove that, within the 60 months preceding the start of the procurement, it has completed at least one similar construction contract that meets the requirements. Acceptable references are either: 1) full construction or reconstruction of a land improvement system, including at least 35 km of ditches and at least 90 culverts with a diameter of at least 400 mm; or 2) renewal or maintenance of a land improvement system, including at least 175 km of ditch restoration and maintenance of at least 250 culverts with a diameter of at least 450 mm. The work must have been performed properly, and the contracting authority may require confirmation from the client or main contractor. If the bidder relies on the resources of another undertaking, it must also provide that undertaking’s details and consent. To submit a bid, the bidder must complete the price quotation form, confirm that the bid complies with the tender documents, attach equivalence evidence where needed, and provide proof of the tender guarantee payment or a guarantee letter. In the case of a joint bid, a power of attorney for the joint bidders must be submitted. If requested by the contracting authority, the bidder must also provide the trade secret marking and justification, and confirmation that RMK environmental requirements for forestry work are met.
