Compliance requirements
The contracting authority checks the exclusion grounds under Section 95(1) of the Public Procurement Act for the successful bidder and may require supporting documents before signing the contract if they are not available free of charge from data registers. The bidder must confirm that no exclusion grounds apply, that there is no connection with the preparation of the procurement procedure, that there is no conflict of interest, and that no insolvency or liquidation proceedings have been initiated against it. If an exclusion ground exists, the bidder may submit explanations and evidence of self-cleaning where permitted. In addition, the bidder must confirm compliance with any residence- or establishment-based participation restriction if such a restriction is set out in the procurement documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. As compliance requirements, the bidder must confirm that the offer meets the requirements in the procurement documents, that equivalence has been explained where necessary, and that supporting evidence has been attached. The bidder must have a web-based ordering environment that allows product searches and order placement by item names or product groups and is easy and smooth to use. The bidder must also confirm that subcontractors and suppliers accounting for more than 10% of the contract value are not Russian citizens, residents or undertakings established in the Russian Federation, entities more than 50% owned by such persons or entities, or representatives of or persons acting on the instructions of such persons or entities. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bidder must identify any trade secrets, justify their designation, and confirm that the bid is not conditional. The goods offered must not be subject to international sanctions and must not originate from sanctioned areas.
