Compliance requirements

The bidder must confirm that neither it nor its management, governing or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, child labour, human trafficking, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD also asks whether this information is electronically available.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. However, the compliance conditions require submission of the unit price table for the lot offered, confirmation that the bid complies with the tender documents, and, where relevant, equivalent-solution explanations and evidence. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm that it does not use a subcontractor who would have to be replaced under Section 122(7) of the Public Procurement Act.
