Reconstruction of the Eivere land improvement system and roads

The bidder must confirm that neither the bidder nor members of its management, administrative or supervisory bodies, nor other persons authorised to represent it, have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or offences related to a terrorist act or terrorist activity, where the exclusion period is still in force. The bidder must also confirm that it does not use a subcontractor in contract performance that would have to be replaced under Section 122(7) of the Public Procurement Act. In addition, EU sanctions on Russia must be observed: subcontractors or suppliers representing more than 10% of the contract value may not be Russian citizens, entities established in Russia, or persons/entities owned or controlled by them or acting on their instructions. If an exclusion ground applies, the bidder may submit self-cleaning evidence where permitted.

The bidder must demonstrate technical and professional capability through previous construction works. At least one suitable reference from the 60 months preceding the start of the procurement is required. Suitable experience may be either: - a land improvement system fully built or fully reconstructed under a land improvement project, including at least 20 km of ditches, at least 20 culverts with a diameter of at least 400 mm, and at least 2 km or 10,000 m2 of roads; or - renewal or maintenance of a land improvement system covering at least 100 km of ditch restoration, maintenance of at least 100 culverts, and full construction or reconstruction of at least 2 km or 10,000 m2 of roads. The bidder must provide in the ESPD data on the relevant completed construction contracts. The contracting authority may also request a list of major contracts and confirmations from the clients that the works were carried out properly. The tender must comply with the procurement documents and, where relevant, equivalent solutions must be explained and supported by evidence. Bid security is also required, and in the case of a joint tender, a power of attorney must be provided.
