Compliance requirements
The ESPD lists the usual exclusion grounds: participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, terrorist offences and related offences, and other grounds for exclusion provided by law. The bidder must answer yes/no questions and, where relevant, provide the date of conviction, the reason, the convicted person, the exclusion period, and a description of self-cleaning measures. If the information is electronically available, a link, code and issuer must also be provided. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, that the bid fully complies with the contract notice and tender documents, that all submitted documents form part of the bid, that no subcontractor subject to replacement will be used in contract performance, and that the bidder is not in a conflict-of-interest situation with the contracting authority. The contracting authority may also require replacement of first-tier subcontractors if an exclusion ground applies to them.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last 3 completed financial years must be at least EUR 350,000 per year. Information must be provided on the turnover for each year, the period, the currency and, where applicable, whether the information is electronically available. Within the 60 months preceding publication of the contract notice, the bidder must have carried out at least 1 complex construction, extension or reconstruction project for a public or community building, covering both general construction and technical systems, including a controlled lighting installation and ventilation systems, with a net floor area of at least 1,600 m2. In the case of a joint tender, the bidder must indicate which part of the work was performed by the bidder. In the ESPD, the bidder must provide the client’s name and contact details, a description of the contract object, the performance period to the nearest month, and the net floor area of the works. For direct performance of the contract, the bidder must involve a 3-person team: a project manager with at least construction manager level 6 qualification, a certified heating, ventilation and cooling engineer at level 7, and a certified electrical engineer at level 7 or B-competence class. These persons must have sufficient Estonian language skills to perform their duties; if the language requirement is not met, the bidder must include a statement that translation will be arranged at its own expense. Before contract award, the bidder must submit the team members’ details and proof of their qualifications. The bid must be submitted by the bidder’s legal representative or an authorised representative. In the case of a joint tender, a power of attorney and a statement of joint and several liability must be submitted. The bid must include a price submission table in the format of Annex 4, and where necessary a power of attorney in the format of Annex 2 or Annex 3.
