Leasing of two rigid articulated loaders under operating lease for five years

The bidder must confirm that neither the bidder nor members of its management, administrative or supervisory bodies have been finally convicted within the last 5 years for participation in a criminal organisation, corruption or fraud, and that any exclusion period imposed by the conviction is still in force. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures, where permitted. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The compliance requirements include a separate sanctions condition: the bidder may not involve subcontractors or suppliers worth more than 10% of the contract value who are citizens or residents of the Russian Federation, entities established in Russia, persons/entities more than 50% owned by them, or representatives acting on their instructions. The contracting authority will reject a tender if the resulting contract would be void due to sanctions rules.

The bidder must be entered in the commercial register. To prove technical and professional capacity, the bidder must show that its main business activity, or one of its main activities, is the sale and maintenance of the offered products. In addition, during the 36 months before submission of the tender, the bidder must have sold or leased at least 3 similar loaders described in this tender, priced comparably to the offered telescopic loader. The proof must state the value, dates and the other contracting party. Under the compliance requirements, the bidder must confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary and supporting evidence has been attached, that the tender price has been submitted in the required structure, and that conditional tenders are not allowed. If this is a joint tender, a power of attorney for the joint bidders must be attached and an authorised representative must be named.
