Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other mandatory exclusion grounds listed in the ESPD. The bidder must provide yes/no confirmations and, where relevant, details of the conviction date, reason, convicted person, exclusion period and any self-cleaning measures. If the information is electronically available, a reference must also be provided. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have prior experience in selling balaclavas or other protective clothing items. At least 3 properly performed similar sales contracts are required within the 36 months preceding the start of the procurement, each with a value of at least EUR 20,000 excluding VAT. Similar sales include, among others, sales of firefighter helmets, rescue boots, firefighting clothing and firefighter or rescue gloves. Compliance with the requirement must be confirmed in the ESPD; additional documents are generally not required with the bid. The bid must comply with the technical specification, the bidder must submit one sample before the bid deadline, and must provide a copy of an accredited laboratory or institution certificate and related documents proving compliance with EN 13911:2017 or an equivalent standard. The balaclavas must carry a warranty of at least 12 calendar months. The bid must remain valid for 3 calendar months from the submission deadline. In the case of a joint bid, a power of attorney must be submitted; the existence of trade secrets must be indicated and justified. It must also be confirmed that the goods are not subject to international sanctions and that subcontractors or suppliers linked to the Russian Federation are not engaged for more than 10% of the contract value.
